How to draft a CPCV step by step

The promissory purchase and sale contract (CPCV) formalises the parties’ intent before deed or DPA. This guide describes the usual steps in Portugal and how Propcheckr can support drafting, without replacing lawyer, solicitador or notary.

Step by step

  1. Gather property and party data

    Identify sellers and buyers, describe the property (tax article, address, fraction) and agreed price. Collect base documents: permanent certificate, tax record, habitation licence or equivalent.

  2. Check urban planning and charges

    After DL 108/2026, assess the urban planning certificate (CTU) and the urban title mention in the contract (presented, declaration of having or not having). Check condominium debt for autonomous fractions.

  3. Choose the CPCV template type

    Standard for simple residential, mortgage variant if there is a housing loan, or models for succession/company. The template must reflect agreed suspensive conditions (e.g. bank approval).

  4. Draft and customise clauses
